Zum einen soll versucht werden, Klarheit in die Begrifflichkeiten des Zwanges und insbesondere des Fraktionszwanges zu bringen. Dabei soll versucht werden diesen so häufig verwendeten Begriff zu entzaubern. Anschließend werden die rechtlichen Voraussetzungen für Schröders Vorstoß, sowie dessen Rechtmäßigkeit erläutert. Weiterhin werden die Ereignisse um den 16.11.2001 chronologisch dargestellt. Abschließend wird geprüft, ob es sich bei der Verknüpfung einer Sachentscheidung mit der Vertrauensfrage um Fraktionszwang gehandelt hat.
